This past Father's Day, I lost my dad. He passed away after a long battle with illnesses related to his service as a 9/11 FDNY first responder. Like so many others, he continued answering the call long after the world had stopped watching, spending countless hours in rescue and recovery at Ground Zero. The sacrifices made that day didn't end when the smoke cleared. For many families like ours, we've dealt with this aftermath for decades. Over the past couple weeks, my family and I experienced something we'll ever fully be able to put into words. FDNY isn't just any organization. It is a family in every sense of the word. Watching thousands of firefighters, active and retired, travel from across the country to stand beside us, honor my dad, support my family, and ensure he received the most incredible sendoff was one of the most moving experiences of my life. Growing up, I always knew my dad was a firefighter, however was never able to fully appreciate what that really meant until this week. It means belonging to something much bigger than yourself. It means that even after retirement, after illness, and even after death, you are never forgotten. You are family. To every member of FDNY, the FDNY Foundation, and the Uniformed Firefighters Association, Local 94, I.A.F.F. (FDNY), and to especially those who served alongside my dad over the years, thank you. You remind us that the oath doesn't end when the job does, and that the bond you share extends to families even after the fires are put out. Thank you for a lifetime of adventures, Dad, FDNY for a job that never felt like work, and everyone for your support. It truly takes a village. We are at peace, and feeling so lucky + loved! In a just-released Interpretative Letter (# 1192), the OCC conveyed a strong position on National Bank Act preemption and state money transmitter licensing. In response to a question involving a national trust bank and state money transmitter licensing, the agency reaffirmed that national banks may conduct federally authorized activities nationwide without first obtaining state permission through money transmitter licensing regimes. The OCC's message was much broad and clear: federal banking powers cannot be conditioned on state licensing requirements. The strength of this interpretive letter is made clear in the first paragraph of the letter, where the OCC stated: "This conclusion is clear and unambiguous under applicable law and longstanding precedent." Note that, while this letter relates specifically state money transmission laws and associated licensing requirements, it is useful because it reflects the OCC's continued willingness to take an expansive view of National Bank Act preemption. The letter reinforces the principle that states generally cannot require a national bank to obtain a state license (e.g., money transmission, lending, etc) before exercising federally authorized powers. https://lnkd.in/eHh9VSYK

81% of in-house legal teams use AI for legal work...but only 55% of law firms do, according to a recent independent survey Ironclad commissioned. That 26-point gap tells you change is happening. I've been talking to many GCs and legal ops leaders about how they're integrating AI into their work streams. What I've found is that, while skepticism remains, the once-prevailing concern that AI would replace us is waning. Some critics still don't believe AI is worth their time but the majority of folks I talk to have found success leveraging AI as an augmentation tool. The latter is the case for my team. We've found AI has so far yielded the greatest value by: *Shifting contracts from static documents to data sources that can enable business growth and enable us to move quickly. *Optimizing contract redlining. What used to take us hours now takes minutes. The system runs the contract against my team’s playbooks, applies redlines, and adds notations and citations for why the changes were made. A human in the loop reviewer can then review those changes, validate that they are correct (or modify further) and leverage AI to draft a summary of the edits before shipping off to the next person in the chain. *Improving our data hygiene. We ask AI to help categorize and clean metadata—tracking exactly what terms are contained in what contracts. This context matters. It enhances our agent’s ability to understand our data and create output with smarter analysis to queries that get at helping us better understand our obligations and our risk profile. *Increasing our velocity and reducing burnout by tempering the sheer manual labor of contract processing. If you're not using AI yet, my advice is to start small. Identify tasks that play to LLMs' strengths (pattern matching, data processing) and have low associated risks. Set measurable benchmarks to evaluate what’s working and not. AI will not replace you. And if leveraged properly, it won’t fail you either.

Dynamic and algorithmic pricing isn’t just a tech buzzword anymore — it’s now firmly on regulators’ radars. My Data360 team members, Kathleen McGee and Erich J. Kaletka, did an excellent writeup indicating that state authorities are moving quickly in this area: 1. California AG Rob Bonta has launched a sweep of “surveillance pricing” practices under the CCPA, targeting businesses that use personal data to set individualized prices without clear disclosure. This goes beyond privacy compliance into consumer protection and fairness enforcement. 2. New York’s Algorithmic Pricing Disclosure Act — the first of its kind in the U.S. — is now in effect, requiring companies that use consumers’ personal data to set prices with algorithms to show a conspicuous disclosure: “THIS PRICE WAS SET BY AN ALGORITHM USING YOUR PERSONAL DATA.” Failure to comply can result in significant enforcement action. Taken together, these developments signal a turning point: dynamic pricing strategies that rely on personal data are no longer just an internal business optimization — they are a regulatory and enforcement priority. Businesses that deploy algorithmic or personalized pricing should review their pricing models, disclosures, and data practices now to avoid surprises. #California just sent the clearest signal yet that partial opt-out compliance is not compliance at all. On February 11, the California AG announced a $2.75 million #CCPA settlement, the largest in the law's history, against a major streaming company for failing to ensure that consumer opt-out requests were shared across brands, devices, and ad-tech partners. The core theory here is if your business uses cross-device identity resolution to maximize advertising value, understand that regulators now expect you to use that same infrastructure to honor opt-outs. Opt-outs have to follow the identity graph. This action also framed incomplete opt-outs as consumer deception under California's Unfair Competition Law, not just a technical CCPA violation. That significantly expands the exposure for any organization that labels a control an "opt-out" when it does not fully stop sale and sharing. If your organization operates multiple brands under a shared account ecosystem, relies on third-party ad-tech partners alongside internal ad infrastructure, or supports connected TV or device-native environments, this settlement is a direct message about your compliance posture.
