For years, certain benefits brokers have pitched against PEOs with the same tired line. Sign with a PEO and they take over your company. They hire, they fire, they run your business, you lose control. I say this as a licensed broker myself: that is not how any of this works, and now the federal government has spelled it out. The DOL's proposed joint employer rule lays out a four factor test. Who has the power to hire and fire. Who supervises schedules and working conditions. Who sets the rate and method of pay. Who maintains employment records. Then it does something even more useful. It explicitly lists business practices that do NOT push a company toward joint employer status, and as the attorneys at Fisher Phillips put it, that list reads like a PEO service menu. Payroll. Benefits administration. HR support. The exact things a PEO does every day. Translation: handling your payroll and benefits is not the same thing as running your business. In a properly structured PEO relationship, you keep full control of your operations and your people decisions. What the PEO takes on is real employer responsibility where it matters. Your W-2s are issued under the PEO's EIN. Payroll taxes are filed and remitted under the PEO's EIN. That is genuine skin in the game, not a hostile takeover. Now, if you are filling your production lines and warehouses through staffing agencies, this rule deserves your attention for a very different reason. One of the DOL's own examples concludes that a typical staffing arrangement IS joint employment, meaning shared liability for wages, overtime, and damages. Important stuff for all my staffing brokers out there... The rule is still in the proposal stage, comments close June 22, and this standard has bounced between administrations for a decade. But the direction is clear, and it confirms what I have been telling clients for years. If someone has scared you away from a PEO with the takeover story, let's talk about what co-employment actually means.
