If you use AI for legal work, you should read this and beware. A recent ruling from a US federal court has significant implications for attorney-client privilege in the context of AI usage. The Heppner decision (February 2026) determined that communications involving AI tools, such as ChatGPT and Claude, lack any privilege protection on three grounds: - There is no established attorney-client relationship. - Confidentiality is not upheld under the terms of the platforms. - Counsel did not direct the use of these tools. The situation in India appears even more precarious. The Bar Council of India (BCI) Rules will probably hold the use of consumer AI with client material as a likely violation of professional conduct. Additionally, no Indian court has clarified whether evidentiary privilege under Section 132 of the BSA is maintained. Following a Supreme Court ruling in 2025, communications from in-house counsel are not afforded any privilege. The core issue lies in the fact that Sections 132 and 134 of the BSA protect advocates and clients from compelled disclosure but do not extend that protection to AI providers. This means that companies like Anthropic, OpenAI, or Google can be summoned by a court to produce user data, and they cannot claim privilege. This reality shifts much of the doctrinal debate into the realm of the academic.
