Bates White Economic Consulting
A jury in the Federal District Court for the Eastern District of New York has returned a verdict in favor of Bates White client American Express in the consumer class action case Moskowitz v. American Express Company, finding no antitrust liability or damages. Partners Eric Emch and Eric Gaier testified at trial on behalf of American Express. Plaintiffs alleged that American Express’s non-discrimination provisions (NDPs) in contracts with merchants violate federal and state antitrust laws. Specifically, Plaintiffs alleged that the NDPs restricted competition between credit card networks and resulted in higher credit card acceptance costs for merchants, which were allegedly passed through to consumers in the form of higher retail prices. Partner Eric Emch analyzed Amex’s purported market power in a two-sided platform market, the alleged anticompetitive effects from its NDPs, and the impact on competition of removing them.
