The Inflation Reduction Act (IRA) supercharged clean energy investment—but there’s a catch that could strand billions in assets: Foreign Entity of Concern (FEOC) rules. Starting in 2026, energy storage projects using batteries with components from FEOCs (think China, Russia, North Korea, Iran) lose eligibility for tax credits. That means: No Investment Tax Credit (ITC) No Production Tax Credit (PTC) Why this matters: Most U.S. battery supply chains still rely heavily on Chinese materials and components. Projects planned today could be non-compliant tomorrow, leaving investors exposed. Retrofits or supply chain shifts aren’t trivial—they require years of planning and billions in capital. This isn’t just a regulatory nuance—it’s a strategic risk. Developers, investors, and OEMs need to audit supply chains now and align procurement with FEOC rules, or risk stranded assets and broken financial models. https://lnkd.in/e5MXGbg5 📢 PJM’s 2027/2028 Capacity Auction: Key Takeaways for Markets & Reliability PJM’s latest Base Residual Auction procured 134,479 MW of generation resources and demand response, with additional capacity from Fixed Resource Requirement plans bringing the total to ~145,800 MW for the 2027/2028 delivery year. The auction cleared at the FERC-approved cap of $333.44/MW-day, modestly higher than last year’s clearing price, reflecting tightening capacity fundamentals. 🔍 What stands out: • Despite robust procurement, total committed capacity is ~6.6 GW below PJM’s one-event-in-10-years reliability benchmark, underscoring ongoing adequacy challenges. • PJM’s peak demand forecast is significantly higher than last year — driven in large part by data center load growth, which accounted for the majority of the increase. • An Incremental Auction in early 2027 will provide another opportunity to attract incremental capacity for the same delivery year. ⚙️ Implications for stakeholders: • Capacity prices at the cap signal that market fundamentals are tight and that new or existing generation investments remain economically relevant. • Load-serving entities and resource developers alike should be evaluating capacity positions, contract strategies, and resource deliverability well ahead of future auctions. • As supply/demand dynamics evolve, ongoing engagement in PJM’s planning processes will be critical.
