    Some percentage of residents and fellows across all specialties require remediation during training. Graduate medical education leaders must navigate remediation steps to optimize resident learning and acquisition of skills, preserve patient safety, and maintain the standards of the specialty.1–3 Standardized approaches to performance management are available for program leaders to achieve favorable remediation results.4–9 In 2015–2016, 1110 of 129 720 (0.86%) residents left or did not…

    Some percentage of residents and fellows across all specialties require remediation during training. Graduate medical education leaders must navigate remediation steps to optimize resident learning and acquisition of skills, preserve patient safety, and maintain the standards of the specialty.1–3 Standardized approaches to performance management are available for program leaders to achieve favorable remediation results.4–9 In 2015–2016, 1110 of 129 720 (0.86%) residents left or did not successfully complete their training program, including 843 residents who withdrew, 249 who were dismissed, and 18 who did not successfully complete training.10 The potential legal implications of successful and unsuccessful remediation are often overlooked. An understanding of the legal landscape surrounding the remediation process is important to protecting stakeholders, including trainees.

Gianopulos is Senior Counsel at Wake Forest Baptist Medical Center, where she has worked since 2006. Her practice at Wake Forest Baptist Medical Center includes a wide range of labor and employment issues that arise in the complex atmosphere of an academic medical center. In 2014, Gianopulos was honored with an award from NC Lawyers Weekly for Women In Justice: Corporate Counsel. She additionally received an award as one of Triad Business’ Top Women In Business in May 2014.
    Gianopulos regularly speaks on employment, medical ethics, and patient related issues. Prior to joining Wake Forest Baptist Medical Center, she was the first General Counsel and Chief Planning Officer at Salem Academy and College in Winston-Salem, North Carolina, and she worked as an Associate at Smith Moore. She clerked for the Honorable William L. Osteen, Sr. in the United States District Court for the Middle District of North Carolina. She received her J.D. from Wake Forest University School of Law, cum laude, in 2001 and graduated magna cum laude from Salem College with a Bachelor of Science degree in Chemistry in 1997.

In the face of general dissatisfaction with the model forms, a group convened in early 2012 to explore options for improving advance care planning and advance directives in the Triad region. The group included representatives from…

    A Piedmont Triad Initiative | Advance care planning facilitators have long complained that the statutory model forms were too long and complicated, the literacy level of the forms was simply too high for many people, and some of the form options were very confusing. In the face of general dissatisfaction with the model forms, a group convened in early 2012 to explore options for improving advance care planning and advance directives in the Triad region. The group included representatives from Wake Forest Baptist Health, Novant Health, High Point Regional Health, Cone Health, and Hospice and Palliative CareCenter of Winston-Salem. Participants came from multiple disciplines, including physicians, hospital legal counsel, private elder law and estate planning attorneys, patient representatives, chaplains, and bioethicists.

    After reviewing existing advance directive forms, the group chose to draft a new form for regional use. The new form was tested at several Triad medical centers and was strongly preferred by patients and facilitators to the statutory model forms used previously. The new form is now in use at three of the Triad’s largest hospitals: Wake Forest Baptist Medical Center, Novant Health Forsyth Medical Center, and High Point Regional Hospital.

    When she was growing up in Danbury, Beth Mabe Gianopulos’s favorite saying was, “That’s not fair.”
    “I wanted fairness and justice in everything,” she said.
    As the primary legal counsel on employment issues for Wake Forest Baptist Medical Center, Gianopulos (’01) finds that her work gives her the perfect place to pursue her hard-wired sense of what’s fair for all.

    As the primary legal counsel on employment issues for Wake Forest Baptist Medical Center, Gianopulos (’01) finds that her work gives her the perfect place to pursue her hard-wired sense of what’s fair for all.
    “I like being able to go in and say, ‘You don’t have to be held hostage by this person,” she said. “We can establish discipline and standards.”
    Gianopulos entered Salem College as a chemistry major, and planned on either going to medical school or pursuing a career as a chemist. An internship helped her realize that she related better to people than test tubes, and that she liked a lot of variety in her work. Law school seemed a better fit.
    She visited Wake Forest Law and liked what she saw on the Wake Forest campus.
    “Being from a small town, going to a smaller school, I really liked the smaller class size,” she said.
