J. Robbin Law is proud to share that on July 8, 2026, the Supreme Court of New Jersey issued a unanimous decision in Scott Diana v. LVNV Funding, LLC (A-52-24), affirming the dismissal of claims against our clients and holding that the New Jersey Consumer Finance Licensing Act (CFLA) does not contain an implied private right of action for a borrower to void a loan contract. Applying the well-established Cort v. Ash factors, the Court held that while the plaintiff was a member of the class the statute was meant to benefit, he could not satisfy the other factors. Specifically, the Court reasoned that the history of the CFLA and its predecessor statutes revealed no legislative intent to create a private right to void loan contracts, noting that the ability to void a contract had always been tied to an express private right to "recover from the lender" that the Legislature pointedly omitted from the CFLA. The Court further explained that Subsection 33(b)'s voiding provision is part of a broader penal scheme, and that New Jersey courts generally will not permit private plaintiffs to enforce penal laws absent a clear legislative statement to the contrary.
