Before arbitration is formally filed, there's a lesser-known stage most claimants never see. Once claimants are gathered and verified, attorneys send a demand letter, a formal notice to the company outlining the issue, the alleged harm, and the intent to pursue a claim. Many companies require this step in their own Terms of Service before any formal filing can begin. After that, there's usually a waiting period, often 30 to 90 days, where both sides have the chance to resolve the dispute before moving forward. From a claimant's perspective, this stage can feel quiet. Most of the activity happens between legal teams. You're not expected to take any action unless contacted for more information. This phase creates a documented record, signals to the company how many claimants are involved, and can shape how seriously the other side engages. What you can prove matters more than what you can argue. In consumer protection claims, arbitrators assess evidence. That means the records you submit carry more weight than explanations offered after the fact. The types of documentation that tend to make the biggest difference include: - Agreements and terms in effect at the time you enrolled or made a transaction Disclosures showing how and when information was presented to you before a charge occurred - Timestamps that build a clear, coherent timeline of events - Transaction records like receipts and bank statements confirming amounts and dates - Written communications, such as emails or chat transcripts, showing what a company represented to you The good news is that most of this documentation already exists in ordinary places: your inbox, your camera roll, your bank account history.
